What To Expect in Texas Family Law Mediation
Depending on the circumstances of your dispute, mediation is almost always an option in family court. In order to make the best choice to protect yourself and your family, it’s best to understand what mediation is and how it works in Texas.
How mediation works in Texas family court
Sometimes, it’s best to resolve legal disputes outside of court. That’s where mediation comes into play. Mediation gives you the opportunity to resolve a dispute using a trained, neutral mediator.
The mediator will work with you to establish a satisfactory resolution. Once that has occurred, they will write up an agreement that is enforceable in court.
What to expect in mediation in Texas
Before mediation begins, the mediator may schedule a call to speak to each party individually. This call is usually confidential and allows the mediator to establish an understanding of each party’s position.
To begin the mediation process, the parties will attend a joint meeting with the mediator. Typically, the mediator will briefly explain the mediation process and then each party will have a chance to make a short statement.
Each party may also ask clarifying questions as needed.
From this point, the mediator will meet with each party individually. These meetings are also known as a “caucus.” During these meetings, any confidential information will remain confidential unless the mediator is given specific permission to share the information with the other party. It’s helpful, however, for you to provide information about the reason the request is made and why you believe them to be appropriate.
These meetings (caucuses) may continue with the mediator bringing offers and counter-offers to each party as necessary. It’s also not uncommon to have one or more additional joint meetings if it is deemed necessary.
Once the parties have come to an agreement, this agreement is written up by the mediator and signed by all parties. This effectively ends the mediation.
