It’s important that we point out that many cases never actually see the inside of a courtroom. A good majority of family law cases in Texas settle without ever going to trial. That can certainly be the case when it comes to Visitation/Possession and Access.

The parent who gets visitation is the parent who does not live with the children. There are a few different types of visitation in Texas:

  1. Standard possession order

  2. Modified possession order

  3. Modified under three possession order 

  4. Supervised visitation order

Child Visitation in Texas | What does it look like & what is the court’s role?

As you may know, visitation arrangements can look very different from family to family. It may be a comfort to you to know that parents can agree to virtually any visitation schedule. If the parents cannot come to an agreement, the child visitation will follow a schedule developed by Texas legislature that is carefully designed to be fair and workable for most families in most circumstances.

Typically, the courts will allow the parties to work out an arrangement between themselves that they believe to be the best for their child. In these cases, the parents can generally schedule the visits by agreement. If, for some reason, they cannot agree at any point, the court order is called in to play for backup support.
